1. Agreement
These Terms of Service (“Terms”) govern access to and use of getpicking.com and related services (the “Service”) operated by Get Picking. If you do not agree, do not use the Service.
2. What Get Picking is
Get Picking is an informational directory of u-pick / pick-your-own farms, season calendars, maps, and related content. We are not a booking platform, travel agency, or operator of the farms listed. Farm ownership, hours, prices, crop availability, and safety practices are controlled by each farm — not by us.
3. Accounts
- You must provide accurate information when registering.
- You are responsible for keeping your login credentials secure.
- You must be at least 13 years old to create an account.
- We may suspend or terminate accounts that abuse the Service, spam submissions, or violate these Terms.
4. User submissions
If you add, claim, or update a farm listing, you grant Get Picking a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with the Service. You represent that you have the right to submit the information and that it is not misleading or unlawful.
Submissions may be reviewed before publishing. We may edit, refuse, or remove content at our discretion.
5. Acceptable use
You agree not to:
- Scrape, harvest, or systematically copy the directory in a way that harms the Service
- Submit false, fraudulent, or infringing content
- Attempt to gain unauthorized access to systems or other users’ accounts
- Use the Service to spam, harass, or violate any law
- Interfere with ads, security, or site performance
6. Intellectual property
The Get Picking name, site design, original text, and compilation of the directory are protected by intellectual property laws. Farm names and third-party marks belong to their respective owners. Map tiles and open data remain subject to their providers’ licenses.
7. Advertising
The Service may display third-party advertisements (including Google AdSense, Mediavine, or similar networks). Ad content is provided by third parties; we do not endorse every advertiser. Ad partners may use cookies as described in our Privacy Policy and Cookie Policy.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Farm details, seasons, maps, and directions may be incomplete, outdated, or inaccurate. Always verify with the farm before traveling. See our Disclaimer.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GET PICKING AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY LISTING. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
10. Indemnity
You agree to indemnify and hold harmless Get Picking from claims arising out of your submissions, your misuse of the Service, or your violation of these Terms.
11. Third-party links
Listings may link to farm websites, maps, or other third-party services. We are not responsible for their content or practices.
12. Changes
We may update these Terms by posting a new version on this page. Continued use after changes constitutes acceptance.
